Stallion Service Contract for Transported Semen

 

This contract for the 2014 breeding season, made and entered into by and between,

MELLANIE BURKHART, CONFETTI FARMS,         herein designated as stallion owner,

 

and

Herein after designated as mare owner. For the __________________Breeding season(“Present breeding season”) subject to the following terms and conditions.

THE MARE OWNERS AGREES THAT________

Prior to shipping, the mare will have been checked by a Veterinarian, certifying that she is healthy, and is in sound breeding condition (negative culture) If no certification exists, the stallion owner will not send semen.

 

The mare owner agrees to give stallion owner notice when mare begins heat, and call by 6:00pm P.S.T. evening prior to shipping.  Collection is available Mon, Wed, and Fri excluding Sundays, no shipping available.  Stallion owner will not ship more than 3 times per heat cycle. Semen will be shipped overnight only. No airline available. After insemination, mare owner agrees to have mare ultra sounded at 16 to 18 days to find out pregnancy status for rebreeding.__________initial here.

 

PURCHASER WOULD LIKE TO USE:

 

 The stallion, ButterwapConfetti, reg# ApHC 597811,

 

FEES: Purchaser agrees to pay the farm the following fees:

A non-refundable booking fee of  $100.00 is due at the signing of this contract. This fee is deducted from

Stallions Service fee.

 

Butterwap Confetti, who’s service fee is $950.00,

 

Includes 1 shipments of semen

Each addition shipment…. $200.00 chute fee per collection (includes collection, container use, and shipping)

Saturday delivery and special handling will be extra.

A $50.00 charge will be added if container is not returned in a good reusable condition.

A total of $950.00 which is to be paid prior to shipment of semen.

 

Purchaser must  pay for all chute fee’s in advance or shipment will not be made. In lieu of a credit card purchaser may send a deposit

of  $200.00 or Confetti Farms  excepts paypal and is preferred.

Shipments MUST be paid for in advance. No exceptions!

Returning the container: After receipt and use of semen, container must be shipped back to the farm via FED Economy or US Post office

2-3 day delivery. Container must be free of semen and used syringes and be clean and undamaged.

DO NOT cross out any writing on box, doing so will deem box unusable for future shipments, just label and send.

 

RESERVATIONS FOR SHIPPED SEMEN: The farms receipt of the above Stallion Service Fee confirms the Mare’s reservation to breed to the stallion for the present breeding

season which shall Feb 1st  to July 15th unless previous arrangements have been made and added to contract.

All orders on semen shipments shall be filled as received, subject to availability of the stallion.

 

CONDITIONS: Stallions services will be provided only to healthy mares in sound breeding condition, as determined by a Veterinarian acceptable by the Farm. In the event

 the Mare is barren by a certification from a Veterinarian a replacement mare may be used at the stallion owners approval, the Farm requires the submission of a recent negative intrauterine culture certificate  (within 60days is acceptable if mare has not been serviced by another stallion since culture or if mare is being bred on foal heat if mare did not retain her placenta)

In some cases the Farm may also require a uterine biopsy and/or Progesterone assay. In all cases, the Veterinarian must certify that the Mare’s immunizations for

Equine  Rhinopmeumonitis (equine herpes 1) have been kept current. .__________initial here

 

 Stallion Service Contract for Transported Semen with a color guarantee. (appaloosa coat pattern or Appaloosa Characteristics) If foal is born with out appaloosa coat pattern or Appaloosa Characteristics

The purchaser has choice to rebreed the same mare the same foaling year only, at no additional breeding fee. All additional chute fee’s are required prior to shipping.

 

 

RETURN OF SERVICE

 

Purchaser shall not be entitled to a refund of fee’s paid hereunder except as set forth below.

However the Mare owner shall have the right of return for Stallion’s Service in the following breeding season and in the third breeding season only in the following circumstances:

 

 1) Mare does not settle during present breeding season, she is eligible to a return of service to the stallion if the

Purchaser submits a veterinarians’s certificate to that effect. The Purchaser recognizes the right to require a negative

Intrauterine culture and or Uterine biopsy, prior to the mare’s return to service

.

 2)If the Mare is confirmed in foal, but loses foal during gestation. Should the mare prove barren, the mare owner will send notice of same, signed by a licensed Veterinarian with in 5 days

 of such barren determination or cause of death.

 

 3) If the Mare produces a live foal that is unable to stand alone and nurse, and subsequently dies.

 

In all cases, a Veterinary certificate will be required stating reason for death, and also shall affirm that the mare was properly cared for, during the gestation and that the Mare had

been immunized for Equine rhinopneumonitis (equine herpes type 1 ) during pregnancy and the dates of such vaccination and that mare was attended at foaling.

The farms timely receipt of the required vet certificate is the precedent to any right of return.  A negative intrauterine culture is required prior to mares return for service.

****Mare owner may substitute another mare with prior permission from stallion owner, along with a new contract listing replacement mare.

A live foal guarantee-meaning, foal can stand-alone and nurse.

 

 

 

THE STALLION OWNER AND MARE OWNER, MUTUALLY AGREE THAT______

 

 

REFUND OF FEES:

The contract shall be null and void and be entitled to a refund or the purchaser shall be entitled to breed to available stallion on Farm as a replacement, if available.

should the above named Stallion die or become unfit for services prior to servicing the mare in the present breeding season.

The purchaser shall not be entitled to $500.00 refund if the Stallion should die, or become unfit for service after semen has been shipped or in any subsequent breeding season.

if stallion is Sold, purchaser will be entitled to a $500.00 refund or frozen semen if available.

NON-ASSIGNMENT: This contract cannot be assigned or transferred by Purchaser. There shall be no right of return to

the stallion if the mare is sold or otherwise changes ownership after being served by the Stallion.

WARRANTY: The farm is not responsible for lost, delayed, or damaged semen and makes no representations or warranties

 of any kind with respect to any semen furnished hereunder except that it is the Stallions and that every effort has been made to provide

quality service.

Stallion service certificates will be issued when all fees and bills, have been paid in full,

And the payment of all fees is a condition precedent for the issuance of such certificates.
